Supreme People’s Procuracy prosecutes Trinh Xuan Thanh

HCMC – The Supreme People’s Procuracy has brought an indictment against Trinh Xuan Thanh and his accomplices for wrongdoing at Vietnam National Oil and Gas Group (PVN) and PetroVietnam Construction Corporation (PVC), Phap Luat newspaper reports.

The case of intentionally violating State regulations on economic management causing serious consequences and property embezzlement at PVN and PVC is a serious one and has captured the attention of the public. Defendants in the case held key positions at major economic units, including Thai Binh 2 thermal power plant project.

Investigation results have established enough grounds for offenses of the defendants.

In particular, in the implementation of the Thai Binh 2 project, former PVN chairman Dinh La Thang played a main role in assigning PVN to execute the EPC contract, and PV Power to sign EPC contract No. 33 with PVC wrongfully.

He then instructed subordinates at PVN and the project’s management board, based on the contract, to advance over US$6.6 million and VND1.31 trillion to PVC, enabling Trinh Xuan Thanh and his accomplices to use more than VND1.115 trillion for wrong purposes. This caused losses of over VND119 billion to the State.

With such an act, Thang is charged with intentionally violating State regulations on economic management under Article 165 of the 1999 Penal Code. He admitted the wrongdoing at the project as its former leader.

As for Trinh Xuan Thanh, former PVC chairman, he instructed Vu Duc Thuan to sign EPC contract No. 33 so that PVC could receive an advance of over US$6.6 million and VND1.31 trillion. Thanh decided to use VND1.115 trillion for other purposes, instead of disbursing the sum to Thai Binh 2 project.

In addition, Thanh and Thuan instructed Nguyen Anh Minh and Luong Van Hoa to falsify documents, withdrawing more than VND13 billion from the management unit of the Vung Ang-Quang Trach project for personal use. Of this amount, Thanh got VND4 billion and is responsible for the use of VND1.5 billion with Vu Duc Thuan, Nguyen Anh Minh and Bui Manh Hien.

Thanh is hence charged with intentionally violating State regulations on economic management and embezzling property under Article 165 and Article 278 of the 1999 Penal Code. He is not honest, and together with his taking flight, caused difficulties for the investigation process.

Besides Trinh Xuan Thanh, other defendants include former general director of PVN Phung Dinh Thuc, former deputy general director of PVN Nguyen Quoc Khanh, former deputy general director of PVN Nguyen Xuan Son, former general director of PVC Vu Duc Thuan, and deputy general director of PVC Nguyen Anh Minh.

Other accomplices include director of Vung Ang-Quang Trach Project Management Board Luong Van Hoa, head of PVC Office Bui Manh Hien, chief accountant and head of finance and accounting at PVN Ninh Van Quynh, deputy head of finance-accounting-auditing at PVN Le Dinh Mau, former head of Thai Binh 2 Project Management Unit Vu Hong Chuong, chief accountant of the Project Management Unit Tran Van Nguyen, vice chairman of PVC Nguyen Ngoc Quy, and deputy general director of PVC Nguyen Manh Tien.
