HCMC allows short-term public land leases for up to five years

HCMC – HCMC will begin offering short-term leases of public land for up to 60 months (five years) under newly issued regulations, effective June 5, said local media reports.

The HCMC People’s Committee will permit short-term leases on certain types of public land, including land slated for auction, land designated for BT (build-transfer) contract settlements, and land that has been cleared and compensated.

Initial lease terms will be 12 months, with the option for multiple renewals, provided the total lease period does not exceed 60 months.

Previously, these land lots remained unused due to the lack of a legal framework.

In 2024, the Government issued Decree 102 guiding the implementation of the Land Law, which includes specific provisions on the management and use of public land for short-term purposes (Article 43). This has enabled HCMC to introduce regulations allowing short-term leases, helping to boost budget revenues.

For rental pricing, the city will apply the following formula: Monthly rent = (Land price based on the official price list × Percentage rate) ÷ 12. The percentage rate will range from 0.25% to 3%, depending on the area and location.
