HCMC – HCMC is preparing to issue a new decision regulating land subdivision and consolidation to replace multiple overlapping rules currently applied across areas in the post-merged city.
Nguyen Toan Thang, director of the HCMC Department of Agriculture and Environment, has submitted Proposal No. 1187 to the city People’s Committee, requesting approval to develop a unified decision on conditions for land subdivision and consolidation.
The department said the city is currently applying three separate regulations inherited from before the administrative merger, including Decision No. 100 for the former HCMC area, Decision No. 38 for the former Binh Duong area, and Decision No. 24 for the former Ba Ria–Vung Tau area.
The concurrent application of different regulations has created difficulties for State management of land and complicated administrative procedures for land users. If a unified regulation is not issued in a timely manner, inconsistencies in implementation could continue and affect the legitimate rights of land users when exercising subdivision and consolidation rights, the department noted.
The proposed decision will provide specific conditions for land subdivision and consolidation, as well as minimum sizes for each land category across HCMC, in line with the 2024 Land Law.
The regulations will apply to households, individuals and organizations with rights and obligations related to land subdivision and consolidation, as well as competent State agencies responsible for land administration.
The draft decision comprises eight articles, covering general principles and conditions for subdivision and consolidation, detailed provisions on minimum sizes for residential land and other land types, including agricultural land and non-residential non-agricultural land, responsibilities of relevant agencies and commune-level authorities, and transitional arrangements for dossiers submitted before the decision takes effect.
The city expects the decision to be issued before February 28.
To gather feedback, the Department of Agriculture and Environment is scheduled to hold a consultation workshop this afternoon (February 3) on the draft regulations. The workshop, chaired by Nguyen Toan Thang, will involve representatives from relevant departments and land registration offices in the former HCMC, Binh Duong and Ba Ria–Vung Tau.
