HCMC – The HCMC Real Estate Association (HoREA) has proposed capping land use fees at 20% of the official land prices for areas within the quota and 30% for excess areas.
Current regulations under Decree 103/2024 require land use fees to be calculated at 100% of the listed land price for the entire area. HoREA said this would result in fees that exceed the financial capacity of many households and individuals.
The association outlined two options. The first is to amend Decree 103, reducing the rates to 20% and 30%, lower than the Finance Ministry’s proposed 30% and 50%. This option would require approval from the National Assembly’s Standing Committee.
The second option, favored by HoREA, is for the Government to issue a temporary resolution applying the 20% and 30% rates. The association said this approach would provide flexibility while awaiting legal revisions.
HoREA also called for the rates to be standardized nationwide to avoid disparities between localities and to prevent potential revenue losses. It recommended that provincial authorities refund households and individuals for overpayments made under the previous regulations.
