Vietnam suspends enforcement of Decree 46 on food safety

HCMC – Vietnam’s Government has suspended Decree No. 46/2026/ND-CP on food safety, pending the enactment of a revised Law on Food Safety and its guiding regulations.

Under Resolution No. 15/2026/NQ-CP dated April 6, the Government will temporarily halt the application of Decree No. 46/2026/ND-CP, which was issued in January to detail several provisions of the current food safety law.

The suspension will remain in place until a revised Law on Food Safety takes effect.

Resolution No. 66.13/2026/NQ-CP, which governs the announcement and registration of food products, will be also suspended.

Authorities will continue to keep Decree No. 15/2018/ND-CP and related guidelines in force to ensure that food safety management remains uninterrupted.

The ministries of Health, Industry and Trade, and Agriculture and Environment have been instructed to implement the resolution within their respective mandates, including stepping up inspections and oversight across the food supply chain, from production to distribution, as well as imports and exports.

They are also required to review and update relevant legal documents, technical standards, and professional procedures related to food safety.

The Government has also tasked relevant agencies with reviewing the 2010 Law on Food Safety and proposing amendments in line with current conditions. These proposals will be consolidated by the Ministry of Health to support the drafting of a revised law.

Earlier this year, imports were delayed as the absence of implementing guidelines for Decree No. 46 made customs clearance procedures impossible.

In reponse, the Government decided to suspend the implementation of Decree 46 until April 15.
