Vietnam to reclaim unused public land, buildings

HCMC – Vietnam will begin reclaiming public land and buildings left unused for over 12 months under Government Decree No. 3/2025, which took effect on January 1 this year.

The decree outlines measures to manage public assets, including land and buildings, and provides five options for handling such properties: continued use, reclamation, inter-agency transfer, delegation to local authorities, or temporary retention for further review.

Public properties deemed unused, improperly allocated, or ineffective due to organizational changes will be subject to reclamation. Provincial authorities will oversee the process, covering assets managed by both local and central government entities.

Transfers will only be permitted for specific purposes, such as reallocating properties for state-owned enterprise office use. Transfers for real estate or commercial development are strictly prohibited.

Hanoi City has approved plans to reorganize over 10,760 public properties and has completed reviews for more than 6,000. Starting January 2025, the city will conduct a full inventory of public assets. Similarly, HCMC will target over 1,000 vacant properties, with results expected by July 2025.

Special cases, such as transfers to the Ministry of Defense or the Ministry of Public Security, will be decided by the prime minister. Other decisions will fall under the jurisdiction of the Ministry of Finance, central agency leaders, or local authorities.
