HCMC – The Ministry of Industry and Trade has required used cars imported under tariff-rate quotas within the framework of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) to comply with rules of origin and present certificates of origin at the time of customs clearance, under Circular 08/2026/TT-BCT issued on February 25, 2026.
The circular amends Circular 04/2020/TT-BCT on auctioning tariff-rate quotas for used car imports. It clarifies that only vehicles meeting CPTPP origin criteria are eligible for preferential tariffs under the quota mechanism.
A key revision stipulates that used cars imported under tariff-rate quotas must meet CPTPP rules of origin and be accompanied by valid certificates of origin when import procedures are conducted. The requirement is specified more clearly compared to previous regulations to ensure that only vehicles meeting origin criteria within the CPTPP bloc are eligible for preferential tariff treatment under the quota mechanism.
The circular also amends Clause 1, Article 6 of Circular 04/2020/TT-BCT to clarify principles, order and procedures for auctioning tariff-rate quotas in accordance with the law on asset auctions. The unified reference to the general legal framework aims to improve transparency and address difficulties in organizing auctions.
In addition, Circular 08 revises terminology in Appendix I by replacing “engine power ≤ 3,000 cm³” with “engine displacement ≤ 3,000 cm³” and “engine power ≥ 3,000 cm³” with “engine displacement > 3,000 cm³,” standardizing technical terms and clarifying vehicle classification by cylinder capacity.
