Constitutional amendment approved, with district-level administrations abolished

HCMC – The National Assembly (NA) passed a resolution amending and supplementing several articles of the 2013 Constitution on the morning of June 16, with all 470 deputies present voting in favor.

The resolution takes effect upon its passage, with the State President tasked with formally promulgating it.

Under the amendment, Article 110 now stipulates that Vietnam’s administrative structure consists of two tiers: provinces and centrally administered cities, along with sub-provincial administrative units as prescribed by law.

Special administrative-economic units are established by the legislature.

The establishment, dissolution, merger, division, or adjustment of administrative boundaries must involve local public consultation and follow procedures prescribed by the legislative body.

The revised Article 111 states that local governments are established at Vietnam’s administrative units. Each local administration includes a People’s Council and a People’s Committee, structured to reflect the specific characteristics of rural, urban, or island regions.

The resolution also specifies that all district-level administrative units nationwide will cease operations as from July 1.

Based on notifications from the competent Party committees responsible for personnel management, the NA Standing Committee will appoint the chairpersons and vice chairpersons of the People’s Councils, heads of Council committees, and heads and deputy heads of NA deputies delegations in provinces and centrally governed cities newly formed after the administrative reorganization.

The prime minister will appoint chairpersons and vice chairpersons of the People’s Committees in newly established provinces and centrally governed cities following the reorganization.

The Standing Committees of the People’s Councils in these localities will appoint committee members, as well as chairpersons, vice chairpersons, and heads of the People’s Council committees, along with chairpersons and vice chairpersons of the People’s Committees in the newly formed sub-provincial units.

For these sub-provincial units, the Standing Committees of the local People’s Councils will also appoint members of the corresponding People’s Committees.
