Facilities to pay annual environmental fees for emissions

HCMC – The Government has issued Decree 153/2024/ND-CP on environmental fees for air emissions, effective January 5, 2025, which mandates a fixed annual fee of VND3 million for facilities without emission monitoring equipment.

Under the decree, production, business, and service facilities must obtain an environmental permit and pay a fee if they release industrial air emissions. This regulation applies to industries such as metallurgy, chemicals, energy, waste treatment, and other businesses generating industrial emissions.

The decree provides specific methods for calculating fees based on whether a facility is required to monitor emissions.

Facilities not obligated to monitor emissions will pay a fixed annual fee of VND3 million. For facilities established before the decree’s effective date or starting operations thereafter, the fee will be calculated monthly based on their actual operating time.

Facilities required to monitor emissions will pay an additional fee based on the volume of pollutants released, including dust, NOx, SOx, and CO. Rates are set at VND800 per ton per hour for dust and NOx, VND700 for SOx, and VND500 for CO.

To encourage facilities to reduce pollution, the decree includes a provision for reduced fees. If the average concentration of a pollutant is less than 30% of the allowable limit, the fee for that pollutant will be reduced to 75% of the standard rate.
