NA approves amended Law on Government Organization

HCMC – Vietnam’s legislative body approved the amended Law on Organization of the Government on the morning of February 18, with 463 out of 465 deputies present voting in favor. This law will take effect from March 1, 2025.

The newly passed law has significantly reformed the mechanism for defining authority, decentralization, and delegation to implement the Party’s policy of strengthening decentralization and delegation of power.

It also enhances the accountability of leaders, promotes proactivity and creativity, and encourages agencies within the state apparatus to think boldly, act decisively, and take responsibility.

It also aims to promptly address institutional bottlenecks and administrative procedures, unlock resources for development, and proactively respond to domestic and international changes, all in pursuit of the country’s overall growth and development goals.

A key new provision regarding the duties and powers of the Government is that it exercises unified state management over various sectors and fields.

The Government assigns state management responsibilities to ministries and ministerial-level agencies, delegating authority to ministers and heads of ministerial-level agencies based on their respective scopes of management. This ensures a clear distinction between their responsibilities as members of the Government and as heads of their respective ministries or agencies.

The Government determines development policies for industries, regions, and localities, except for policies under the authority of the National Assembly and local governments. These policies must align with the Party’s guidelines, as well as the country’s socio-economic development strategies, plans, goals, targets, and fundamental policies approved by the National Assembly.

For matters that have been delegated to local governments, they have the autonomy to decide, implement, and take full responsibility for the outcomes of their assigned tasks.
