HCMC – The U.S. Department of Commerce (DOC) has received a request for an anti-dumping and anti-subsidy investigation into frozen warm water shrimp imports from Ecuador, India, Indonesia, and Vietnam.
The Trade Remedies Authority of Vietnam under the Ministry of Industry and Trade said the investigation specifically targets frozen warm water shrimp products. For Vietnam, only an anti-subsidy investigation is required, as the U.S. has been imposing anti-dumping duties on shrimp imports from Vietnam since 2004.
The appeal for an anti-subsidy probe into frozen and fresh shrimp imports from Vietnam pertains to the period of 2022, considering losses incurred from 2020 to the first half of this year. According to the Trade Remedies Authority of Vietnam, the claimant alleges that shrimp products from Vietnam have been subject to a series of subsidy programs, resulting in losses or potential threats to the U.S. shrimp manufacturing industry.
Vietnam has the right to engage in consultations with the DOC regarding this appeal, and the DOC will have 20 days to consider the request. A decision on whether to initiate an investigation will be made by November 14, 2023, with the possibility of extending the deadline to 40 days in exceptional cases.
Simultaneously, the U.S. International Trade Committee (USITC) will require 45 days to review the case before issuing a preliminary conclusion on the alleged losses. If the USITC determines that no losses have occurred, the case will be closed.
The Trade Remedies Authority of Vietnam advises businesses exporting products subject to these investigations to prepare response plans in anticipation of a possible DOC investigation.
