Ministry seeks to amend Land Law this year

HCMC – The Ministry of Agriculture and Environment has proposed amending the Land Law this year, with a draft law to revise and supplement several provisions of the 2024 Land Law submitted to the Government for inclusion in the 2026 legislative agenda.

The proposed amendments aim to improve land policies and remove bottlenecks to unlock resources for economic growth during the 2026-2030 period, according to a report posted on the ministry’s website.

After nearly two years of implementing the 2024 Land Law, many issues have been addressed through more than 26 guiding and amending documents. However, the rollout of a two-tier local government model, along with greater decentralization and delegation of authority, has created the need to revise several provisions.

The ministry said the amendments would focus on two main areas, including measures to support economic growth and revisions tied to administrative reform and delegation of authority.

Under the proposal, several mechanisms currently governed by Government decrees and resolutions would be incorporated directly into the law. These include regulations on land pricing, land use fees, land recovery and compensation, land use right certificates, land planning, land allocation and leasing, and dispute settlement.

The ministry also proposed revising rules on commune-level land use planning, the rights and obligations of rice farmland users, and the handling of land violations committed before July 1, 2014.

As part of broader administrative reforms, authorities also plan to revise provisions related to land management powers by replacing references to “district” and “district level” authorities with broader terms such as “competent authority or person,” in line with the new governance structure.
