HCMC – Starting May 15, individuals using new-generation cigarettes, such as e-cigarettes and heated tobacco products, in Vietnam could face administrative fines of VND3-5 million, along with mandatory confiscation and destruction of the products, under Decree 90/2026/ND-CP.
In addition to penalties for users, the decree also imposes fines of VND5-10 million on individuals or organizations that allow others to use vaping or heated tobacco products at premises under their management, except in cases involving family members. Smoking cessation service providers that fail to meet requirements on counseling facilities, communication materials, or contact systems may face fines of VND1-2 million.
The new regulation comes as the use of next-generation tobacco products rises sharply, particularly among young people.
Studies by the Hanoi University of Public Health show that new-generation cigarette use is increasingly common among youth, with the average age of initiation at around 16.9 years. Surveys in major cities found that about 14% of university students have tried e-cigarettes, with many still holding the misconception that such products are harmless or nicotine-free.
Health experts warn that nicotine in these products can negatively affect brain development in young users, impair learning ability, and pose risks of poisoning from volatile organic compounds mixed in vaping liquids.
